Mediation is a form of Alternative Dispute Resolution (ADR), a way of resolving disputes between two or more parties. The mediator assists the parties with creating a memorandum of understanding (MOU) that is agreed to by all parties which are then put into a settlement agreement. ADR has been around since the early 1970’s when first used by the construction industry to resolve conflicts. ADR process is used widely in the government sector but has not been readily available for the public Mediation is designed to defuse conflict and promote communication which allows parties to create a unique agreement that incorporates everyone’s needs. Lawyers are involved, however, not until the MOU is completed. Mediation can be used in situations where large corporations are buying business such as physio clinics, optometry clinics or family owned businesses. It has been successful in those areas because potentially there is a lot of parties involved and everyone must know their rights and obligations in order to negotiate on their own and advocate for themselves.
